Международная регистрация №1471041 с конвенционным риоритетом от 27.04.2018 была произведена Международным бюро Всемирной организации интеллектуальной собственности на имя Avex Inc., Japan (далее - правообладатель).в отношении товаров 03, 09, 14, 16, 18, 20, 21, 24-26, 28, 30, 32 и услуг 41, 43 классов МКТУ, указанных в регистрации.

Знак по международной регистрации №1471041 представляет собой словесное обозначение PEN PINEAPPLE APPLE PEN, выполненное стандартным шрифтом буквами латинского алфавита и расположенное на одной строке.

В Федеральную службу по интеллектуальной собственности (далее – Роспатент) поступило возражение, в котором изложено мнение о том, что правовая охрана указанному знаку предоставлена в нарушение требований, установленных пунктами 6 и 10 статьи 1483 Кодекса.

Доводы возражения сводятся к следующему:

- оспариваемый знак PEN PINEAPPLE APPLE PEN является сходным до степени смешения с широко известным товарным знаком APPLE, охраняемым в Российской Федерации согласно регистрациям, в том числе №№80445, 94833, 512582, 557834, 561893, 581922, 603808, международные регистрации №№ 956402, 978171, 1323866, 1377651, а также с серией товарных знаков, объединенных словесным элементом APPLE, в отношении товаров и услуг 9, 14, 16, 20, 21, 25, 28, 41 классов МКТУ с приоритетом начиная от 23 июля 1986 года, а также с товарным знаком APPLE PENCIL, охраняемым в Российской Федерации согласно регистрации № 596841, в отношении товаров 9 класса МКТУ с приоритетом от 11 сентября 2015 года;

- входящий в оспариваемый товарный знак словесный элемент APPLE является охраняемым в соответствии с настоящим Кодексом средством индивидуализации (товарным знаком) другого лица - корпорации Эппл Инк., охраняемым в Российской Федерации, в том числе по свидетельствам №№ 80445, 94833, 512582, 557834, 561893, 581922, 603808, а также по международным регистрациям №№ 956402, 978171, 1323866, 1377651, в отношении товаров и услуг 9, 14, 16, 20, 21, 25, 28, 41 классов МКТУ;

- входящий в оспариваемый товарный знак словесный элемент APPLE PEN является сходным до степени смешения с охраняемым в соответствии с настоящим Кодексом средством индивидуализации (товарным знаком) APPLE PENCIL другого лица - корпорации Эппл Инк., охраняемым в Российской Федерации согласно регистрации № 596841, в отношении товаров 09 класса МКТУ с приоритетом от 11 сентября 2015 года;

- фирма Эппл Инк. является общеизвестной на территории Российской Федерации (в приложении мы направляем Вам статью из интерактивной энциклопедии Википедия). Одной из предпосылок известности товарных знаков этой фирмы среди потребителей является их продолжительное использование заявителем на протяжении более чем 40 лет. На сегодняшний день фирма Эппл Инк.

– один крупнейших в мире производителей компьютеров, компьютерных программ, цифровых медиаплееров и мобильных телефонов;

- Apple разрабатывает, производит, реализует и продаёт средства мобильной связи и мультимедийные устройства, персональные компьютеры, портативные электронные устройства и портативные цифровые музыкальные проигрыватели, а также различные программные средства, сервисы, принадлежности, сетевые решения, сторонний цифровой контент и приложения. Кроме того, Apple предлагает и оказывает ряд услуг, включая компьютерные услуги, технологические услуги, музыкальные и другие развлекательные услуги, услуги розничной торговли, а также телекоммуникационные услуги;

- сходство словесного элемента APPLE PEN и противопоставленного товарного знака APPLE PENCIL определяется фонетическим и визуальным вхождением, обусловливающим совпадение всех восьми букв и шести звуков, составляющих оспариваемый элемент; следует отметить, что сравниваемые обозначения сходны и по семантическим критериям сходства, поскольку оба вызывают сходные семантические ассоциации: APPLE PENCIL - англ. "Яблочный карандаш", или "карандаш Эппл". APPLE PEN - англ. "Яблочная ручка" или "ручка Эппл". При этом словесные элементы PEN и PENCIL настолько близки по семантике, что указываются в словарях как "синонимы». Элементом оспариваемого товарного знака является словесное обозначение APPLE. Данное словесное обозначение воспроизводит (тождественно) средство индивидуализации (товарный знак) корпорации Apple Inc., ранее зарегистрированное в Российской Федерации в качестве вышеперечисленных товарных знаков в отношении товаров и услуг, среди прочего, 9,14, 16, 20, 21, 25, 28, 41 классов МКТУ (полные данные приведены в приложении);

- независимо от оценки сходства до степени смешения сравниваемых товарных знаков в целом, использование в оспариваемом товарном знаке элемента, тождественного средству индивидуализации другого лица, в любом случае является самостоятельным и достаточным основанием для признания правовой охраны оспариваемого товарного знака неправомерной;

- сходство сравниваемых товарных знаков усиливается в силу того, что помимо товарных знаков APPLE лицу, подавшему возражение, принадлежит целая серия различных товарных знаков, представляющих собой сочетание словесного элемента APPLE с другими словами, в частности, APPLE CARPLAY по свидетельству №560872[13], APPLE SWIFT по свидетельству №591234[14], APPLE WATCH по свидетельствам №№566104[15], 572055[16], APPLE MUSIC по свидетельствам №№596628 [17], 673911 [18], APPLE 3D TOUCH по свидетельствам №№603290[19] и 596552[20], APPLE BOOKS по свидетельству №720015[21], APPLE TV по свидетельству №670255 [22], по международной регистрации № 1445691 [23], APPLE NEWS FORMAT по свидетельству №597649 [23], APPLE NEWS по свидетельству №600659 [24], APPLE TVOS по свидетельству №597239 [25], CONNECTS to APPLE WATCH по свидетельству №597239 [26] и др.;

- в связи с указанным оспариваемый знак PEN PINEAPPLE APPLE PEN может быть воспринят потребителями как продолжение вышеуказанной серии товарных знаков APPLE.

На основании изложенного лицо, подавшее возражение, просит удовлетворить возражение и признать недействительным предоставление правовой охраны знаку по международной регистрации №1471041 в отношении товаров и услуг 9, 14, 16, 20, 21, 25, 28, 41 классов МКТУ.

Уведомленный в установленном порядке о поступившем возражении правообладатель отзыва на возражение не представил и в заседании коллегии не участвовал.

Изучив материалы дела и выслушав лиц, участвующих в рассмотрении возражения, коллегия сочла доводы возражения убедительными.

С учетом даты (27.04.2018) конвенционного приоритета международной регистрации правовая база для оценки охраноспособности знака включает в себя Кодекс и Правила составления, подачи и рассмотрения документов, являющихся основанием для совершения юридически значимых действий по регистрации товарных знаков, знаков обслуживания, коллективных знаков, утвержденные приказом Минэкономразвития России от 20.07.2015 №482, зарегистрированным в Минюсте РФ 18.08.2015, регистрационный № 38572, с датой начала действия 31 августа 2015 (далее – Правила).

В соответствии с подпунктом 2 пункта 6 статьи 1483 Кодекса не могут быть зарегистрированы в качестве товарных знаков обозначения, тождественные или сходные до степени смешения с товарными знаками других лиц, охраняемыми в Российской Федерации, в том числе в соответствии с международным договором Российской Федерации, в отношении однородных товаров и имеющими более ранний приоритет.

Сходство словесных обозначений оценивается по звуковым (фонетическим), графическим (визуальным), смысловым (семантическим) признакам, изложенным в подпунктах (1), (2), (3) пункта 42 Правил.

Признаки, указанные в настоящем пункте, учитываются как каждый в отдельности, так и в различных сочетаниях.

В соответствии с пунктом 45 Правил при установлении однородности товаров определяется принципиальная возможность возникновения у потребителя представления о принадлежности этих товаров одному изготовителю. При этом принимаются во внимание род, вид товаров, их потребительские свойства, функциональное назначение, вид материала, из которого они изготовлены, взаимодополняемость либо взаимозаменяемость товаров, условия и каналы их реализации, круг потребителей и другие признаки.

В соответствии с пунктом 10 Кодекса не могут быть зарегистрированы в качестве товарных знаков в отношении однородных товаров обозначения, элементами которых являются охраняемые в соответствии с настоящим Кодексом средства индивидуализации других лиц, сходные с ними до степени смешения обозначения.

Оспариваемый знак по международной №1471041 представляет собой словесный элемент .

Правовая охрана указанному знаку предоставлена в отношении товаров и услуг, указанных в перечне международной регистрации, а именно: 03 класса МКТУ

rental of blankets; rental of electric toasters for household purposes; rental of microwave ovens for household purposes; rental of hot plates for household purposes; rental of cooking equipment for industrial purposes; rental of non-electric cooking heaters; rental of dishes; rental of kitchen worktops; rental of curtains; rental of furniture; rental of wall hangings; rental of floor coverings; rental of towels; rental of wet wipes.

Согласно возражению признание недействительным предоставления правовой охраны оспариваемому знаку испрашивается на основании его несоответствия требованиям подпункта 2 пункта 6 и пункта 10 статьи 1483 Кодекса в отношении товаров 09, 14, 16, 20, 21, 25, 28 и услуг 41 классов МКТУ, указанных в международной регистрации №1471041.

Как следует из материалов возражения, оспариваемой международной регистрации противопоставляются принадлежащие лицу, подавшему возражение, словесные товарные знаки APPLE по свидетельствам №№80445, 94833, 512582, 557834, 561893, 581922, 603808, а также по международным регистрациям №№ 956402, 978171, 1323866, 1377651[1-11] и товарный знак APPLE PENCIL по свидетельству № 596841 [12], которые охраняются в отношении однородных товаров 09, 14, 16, 20, 21, 25, 28 и услуг 41 классов МКТУ.

Товары 09, 14, 16, 20, 21, 25, 28 и услуги 41 классов МКТУ, указанные в перечне оспариваемой регистрации, и товары 09, 14, 16, 20, 21, 25, 28 и услуги 41 классов МКТУ, в отношении которых охраняются на территории Российской Федерации знаки [1-12], являются однородными, поскольку они либо совпадают по виду, либо соотносятся между собой как категории вид-род, имеют одинаковое назначение, один круг потребителей и одинаковые условия реализации.

Анализ оспариваемого знака по международной регистрации №1471041 на соответствие его требованиям законодательства показал следующее.

Знак по международной регистрации №1471041 содержит в своем составе словесный элемент Apple, тождественный фонетически и семантически и сходный графически с товарными знаками APPLE [1-11] лица, подавшего возражение. При этом следует отметить, что обозначение состоит из лексических единиц английского языка – «Ручка Ананас Яблоко Ручка», которые не образуют какого-либо устойчивого словосочетания.

Таким образом, довод возражения о несоответствии оспариваемого знака требованиям, установленным пунктом 10 статьи 1483 Кодекса следует признать обоснованным.

Кроме того, следует согласиться с лицом, подавшим возражение, что оспариваемый знак сходен до степени смешения с серией товарных знаков, в основу которой положен словесный элемент APPLE, см., например, товарные знаки APPLE PENCIL, APPLE CARPLAY, APPLE SWIFT, APPLE WATCH, APPLE MUSIC, APPLE 3D TOUCH, APPLE MUSIC FOR BUSINESS, APPLE TV, APPLE NEWS FORMAT, APPLE NEWS, APPLE TVOS, CONNECTS to APPLE WATCH [12-26]. Наличие серии знаков, включающих слово Apple с другими словами, обуславливает вывод о возможном восприятии оспариваемого знака как продолжения серии товарных знаков APPLE, принадлежащей лицу, подавшему возражение.

Товары 09, 14, 16, 25, 28 и услуги 41 классов МКТУ, в отношении которых зарегистрирована серия товарных знаков, однородны товарам и услугам соответствующих классов, поскольку они относятся к одним родовым группам, имеют одинаковое назначение, один круг потребителей и одинаковые условия реализации.

В связи с указанным коллегия пришла к выводу, что сравниваемые знаки являются сходными до степени смешения в отношении однородных товаров и услуг ввиду наличия в них тождественного слова APPLE, что позволяет их ассоциировать друг с другом в целом, несмотря на некоторые отличия.

Следовательно, у коллегии имеются также основания для признания оспариваемого знака по международной регистрации №1471041 не соответствующим требованиям подпункта 2 пункта 6 статьи 1483 Кодекса.

Учитывая вышеизложенное, коллегия пришла к выводу о наличии оснований для принятия Роспатентом следующего решения:

удовлетворить возражение, поступившее 27.04.2020, признать недействительным предоставление правовой охраны на территории Российской Федерации знаку по международной регистрации №1471041 в отношении всех товаров 09, 14, 16, 20, 21, 25, 28 и услуг 41 классов МКТУ, указанных в международной регистрации.
